Part 3 – Rules of Use

These standard terms govern all proposals put forward by the seller as well as every remote agreement and purchase finalized between the seller and the buyer.

Prior to finalizing the remote agreement, the buyer will be provided with access to these standard terms. If this cannot reasonably be arranged, the buyer will be notified before the agreement is completed that these terms can be reviewed at the seller’s place of business and will be delivered to the buyer at no cost upon request as soon as feasible.

When the remote agreement is completed online, despite the previous statement and before the agreement is sealed, these standard terms will be shared with the buyer digitally in a format that allows the buyer to save them easily on a long-lasting storage device. If this isn’t workable. Concurrent Modification Exception, the buyer will be informed before the agreement is finalized about where these terms can be accessed online and that they can be sent digitally or through another method free of charge if the buyer asks.

If additional rules specific to a product or service exist alongside these standard terms, the principles in the second and third paragraphs will still apply. In case of any contradictory clauses, the buyer can always rely on the rule that benefits them the most.

If any part or parts of these standard terms are found to be unenforceable or partially void at any point, the rest of the agreement and these terms will continue to stand, and the affected part will be promptly swapped with a rule that mirrors the intent of the original as closely as possible.

Circumstances not addressed by these terms should be evaluated in line with their overall intent and purpose.

Any uncertainty about the meaning or wording of one or more clauses in these standard terms should be understood in keeping with their overall intent and purpose.

Part 4 – Details of Our Offers

If a proposal comes with a set expiration date or specific requirements, this will be clearly highlighted within the proposal itself.

The proposal is not set in stone. The seller retains the flexibility to modify or adjust it as needed.

The proposal includes a thorough and precise explanation of the goods and/or services being presented. This explanation is detailed enough for the buyer to make an informed judgment about the proposal. When the seller includes pictures, they genuinely represent the goods and/or services on offer. However, glaring inaccuracies or slip-ups in the proposal do not obligate the seller.

All pictures, details, and specifications provided in the proposal serve as rough guides only and cannot be used as grounds for claiming damages or cancelling the agreement.

Images of the goods reflect their true appearance, though the seller cannot promise that the colours shown will perfectly match the real-life shades of the items.

Every proposal includes clear details outlining the buyer’s rights and responsibilities upon agreeing to it. This includes, in particular:

Payment Options: We welcome major credit cards, PayPal, Apple Pay and Google Pay.

Range of Payment Choices: We offer several ways to pay, such as: Payment options might differ depending on your region. All available choices are shown clearly when you check out.

Credit and debit cards

Online payment platforms (e.g., PayPal, Apple Pay, Google Pay, Shop Pay)

Shipping Options: Items are sent out via various couriers based on where the order is headed.

How the agreement is finalized and the steps involved;

Whether or not a cancellation option applies;

The process for paying, shipping, and carrying out the agreement;

The time frame during which the proposal can be accepted or how long the seller locks in the price;

Any extra charges for remote communication if the cost of using such technology exceeds the standard rate for that communication method;

Whether the agreement is saved after being finalized and, if so, how the buyer can access it;

How the buyer can review and, if needed, fix the information they’ve submitted before completing the agreement;

Any languages besides English that the agreement can be made in;

The ethical or professional guidelines the seller follows and how the buyer can view them online;

The shortest duration of the remote agreement if it involves an ongoing commitment.

Part 5 – How Agreements Are Made

Unless stated otherwise in paragraph 4, the agreement takes effect once the buyer agrees to the proposal and meets its related requirements.

When the buyer accepts the proposal online, the seller will promptly send a digital confirmation acknowledging receipt of that acceptance. Until this acknowledgment is received, the buyer retains the option to cancel the agreement.

For agreements completed online, the seller will implement suitable technical and organizational safeguards to secure the digital transfer of information and maintain a safe online space. If electronic payment is an option, the seller will ensure robust security practices are followed.

Within legal boundaries, the seller may investigate the buyer’s capacity to fulfil payment duties and any details or circumstances pertinent to responsibly entering into the remote agreement. If this review gives the seller valid grounds to decline the agreement, they can reject an order or request, or impose specific terms for fulfilment, explaining their reasoning.

Alongside the product or service, the seller will supply the buyer with key details in a format that can be easily saved on a long-term storage device. The seller points to additional guidance on their website, including:

The location of the seller’s office where the buyer can send any grievances;

The terms and process for the buyer to use their cancellation rights, or a clear note if cancellation doesn’t apply;

Details on warranties and available support services;

The information outlined in Part 4, paragraph 3 of these terms, unless the seller already shared this with the buyer before the agreement was finalized;

The steps needed to end the agreement if it lasts over a year or has no set end date.

For ongoing agreements, the details in the paragraph above apply only to the initial shipment.

Every agreement depends on the condition that the items in question are sufficiently in stock.

Part 6 – Your Right to Cancel

    Items like personal care goods must remain unopened or be meticulously sanitized before being sent back.

  • Shipped to the proper location:
    Returns need to be mailed to our main storage facility in China. Sending them to the wrong place means we can’t process them, and no money will be refunded.

Approximate Costs for Shipping Returns to China

Here’s a rough guide to the shipping fees for sending items back to our central hub in China. Keep in mind these are ballpark figures—actual costs could shift depending on your package’s dimensions and weight.

Return Process Details

At hello@dealspot.ch, we aim to keep the return experience simple and smooth. Below are the specifics for sending items to our main facility.

Returns Destination

5th Floor North, Starlight Complex
8 Harmony Road 2, Guzhen District
City: Zhongshan
Zip Code: 528421
Region: Guangdong
Country: China

Essential Tips:

  • Cost Estimates: The shipping fees listed are approximations and may change based on your package’s size and weight. Check with your shipping provider for precise rates.

  • Tracking: Use a service with tracking to prevent loss during shipping. Pack items well to avoid damage en route. Returns sent to an incorrect location can’t be handled, and no refunds will be provided.

Need Help?
If you’ve got questions about returning something or need extra support, feel free to email us at hello@dealspot.ch. Our client care team is eager to assist!

Part 8 – Limits on Cancellation

Additional Return Policies

Shipments Turned Away:
If a delivery is declined and sent back to our vendor, we’ll subtract 25% of the item’s listed price from your reimbursement to account for transportation and handling expenses.

Unclaimed Packages:
If a parcel isn’t collected from the delivery point and is returned to our vendor, we’ll reduce the reimbursement by 25% to offset the cost of return shipping.

Wrong Return Destination:
If goods are mailed to an address other than the one we specify, we won’t be able to handle the return, and no money will be refunded. Always use the designated return address to guarantee proper handling.

Cancellation Privilege
As a buyer, you’re entitled to back out of your purchase within 14 days of its arrival. To make use of this privilege:

  • Contact us at hello@dealspot.ch or complete our withdrawal form.

  • Ship the item back to our main storage facility (address provided earlier).

Limits to Cancellation Privilege
You cannot cancel the following:

  • Hygiene-related goods that have been unsealed or used.

  • Items tailored or customized specifically for you.

  • Products showing wear or harm from mishandling.
    Reimbursements for cancellations exclude delivery fees, and the buyer is responsible for covering return shipping costs.

Reimbursement Procedure
We’ll handle reimbursements within 14 working days of receiving the returned goods.
You’ll hear from us within 5 business days after we receive your cancellation request or returned item.
Funds will be returned via the payment method you used, unless we settle on a different option together.

Eco-Friendly Return Strategy
We manage all returns through our central hub in China to:

  • Enhance sustainability: Grouping returns cuts down on carbon emissions and lessens our ecological footprint.

  • Boost effectiveness: A single processing center allows us to manage returns thoughtfully, including options for recycling or repurposing when feasible.

  • Keep prices reasonable: Streamlined operations help us maintain affordable rates for everyone.
    This method might ask a bit more from you, but your effort helps pave the way for a greener tomorrow. We appreciate your cooperation!

Part 9 – How We Set Prices

Throughout the time frame specified in the proposal, the costs of the goods and/or services presented will remain unchanged.
However, despite the statement above, the seller may list items or services with adjustable rates, which can shift due to changes in the financial market beyond the seller’s influence. The link to these market shifts and the understanding that the listed rates are approximate will be clearly noted in the proposal.
Cost adjustments within the first 3 months after the agreement is finalized are allowed only if they stem from legal mandates or rules.
Adjustments to costs starting 3 months after the agreement’s completion are permissible only if the seller has indicated this possibility and:

  • They result from legal obligations or directives; or

  • The buyer has the option to end the agreement on the date the cost adjustment begins.
    All listed prices are vulnerable to mistakes in printing or formatting. The seller takes no responsibility for issues arising from such errors. If these mistakes occur, the seller isn’t required to provide the item at the mistaken price.

Part 10 – Quality and Assurances

The seller promises that the goods and/or services align with the terms of the deal, match the details outlined in the proposal, meet fair expectations of durability and/or functionality, and adhere to the laws and/or official rules in place when the deal is sealed. If mutually settled, the seller also assures the item’s fitness for purposes beyond typical use.
Any assurance given by the seller, maker, or supplier doesn’t alter the legal entitlements and options the buyer can exercise against the seller based on the agreement.
Any flaws or items shipped incorrectly must be flagged to the seller in writing within a week of their arrival. These goods need to be sent back in their initial wrapping and unused state.
The seller’s coverage period mirrors that of the maker, set at 3 years for all items we offer. That said, the seller isn’t accountable for how well the goods suit each buyer’s specific needs, nor for guidance on how to use or apply them.
This coverage doesn’t hold if:

  • The buyer has fixed or altered the received goods themselves or had someone else do so;

  • The goods have been subjected to unusual circumstances, mishandled, or used in ways that ignore the seller’s directions and/or packaging advice;

  • The flaw arises fully or partially from rules the government has set or might set about the type or standard of materials involved.
    Coverage Terms: Every item sold by the business comes with a protection period of at least 1 year, starting from the shipping date.

Part 11 – Sending Your Order

The seller will take utmost care in handling and processing product purchases and evaluating requests for service provision.
The delivery destination is the location the buyer has shared with the business.
Unless otherwise noted in paragraph 4 of this section, the business will carry out confirmed purchases swiftly, within a maximum of 30 days, unless the buyer has agreed to a longer wait. Should there be a delay or if an order can’t be fully or partially completed, the buyer will be informed no later than 30 days after placing the order. In such cases, the buyer can cancel the agreement at no cost and isn’t eligible for damages. However, cancellation isn’t possible once the item is on its way.
All shipping timelines are approximate and not guaranteed. The buyer cannot claim any benefits based on these terms, and missing a shipping timeline doesn’t grant the buyer compensation.
If the agreement is ended as outlined in paragraph 3 of this section, the seller will return the buyer’s payment as quickly as feasible, within 14 days of cancellation at the latest.
If an ordered item can’t be shipped, the seller will strive to supply a substitute product. At the time of delivery, a straightforward notice will clarify that a substitute is being provided. The buyer’s cancellation rights remain intact for substitutes, and the seller will cover return shipping expenses.
The seller assumes responsibility for any harm or loss of goods until they reach the buyer or a pre-arranged representative known to the seller, unless a different arrangement is explicitly made.
Items are dispatched from multiple storage sites globally and always include a tracking code.
The seller bears the risk of damage or loss until the goods arrive at the buyer or their designated contact.

Part 12 – Ongoing Purchases: Length, Ending, and Continuation

Cancellation
The buyer can end an open-ended arrangement for the consistent delivery of goods (such as electricity) or services whenever they choose, following the established cancellation guidelines and giving no more than a one-month heads-up.
For a time-limited arrangement set up for the steady provision of goods (like electricity) or services, the buyer can stop it at any point once the set duration concludes, as long as they stick to the relevant cancellation steps and provide a notice of one month or less.
For the arrangements mentioned above, the buyer can:

  • Cancel whenever they wish, without being tied to a specific moment or window;

  • End it using at least the same method they used to sign up;

  • Always give the same advance notice that the seller has set for themselves.

Continuation
A time-limited arrangement for the regular delivery of goods (including electricity) or services won’t automatically stretch or restart for a fixed span.
That said, despite the point above, an arrangement with a set end date for delivering daily newspapers, news magazines, or weekly publications can quietly roll over for a new fixed span of up to three months, as long as the buyer can halt this extension near its end with a notice of one month or less.
A time-limited arrangement for the steady supply of goods or services can shift to an open-ended one without fanfare, but only if the buyer can walk away from it anytime with a notice of no more than one month—or up to three months if it involves regular but less-than-monthly deliveries of daily newspapers, news magazines, or weekly publications.
A time-limited arrangement for delivering daily or weekly newspapers and magazines (like a sample or starter subscription) won’t quietly carry on and will stop on its own once the trial or starter phase wraps up.

Duration
If an arrangement runs longer than a year, the buyer can choose to end it anytime after that first year with a heads-up of one month or less, unless stopping it before the agreed endpoint isn’t reasonably feasible.

Part 13 – Paying for Your Order

Unless a different arrangement is made, the buyer must settle the owed amount prior to submitting the order outlined in Section 6(1). For service-related agreements, this payment window starts once the buyer receives confirmation of the deal.
The buyer must promptly notify the seller of any mistakes in the payment details they’ve shared or noted.
If the buyer fails to pay, the seller may, within legal limits, add fair fees to the total, provided these were clearly explained to the buyer beforehand.
At Dealspot, we aim to deliver a smooth, safe, and clear payment process. Here’s an overview of our payment rules and practices:

Payment Options We Accept
We offer a range of ways to pay, such as:

  • Credit and debit cards

  • Online payment platforms (e.g., PayPal, Apple Pay, Google Pay, Shop Pay)

  • The choices available might differ depending on your area. All options you can use will be visible when you’re ready to pay.

Our online store adjusts prices to show in your local currency when possible, based on where you are. Payments are handled in the currency you pick at checkout. If you opt for a currency different from your local one, extra fees for currency exchange might apply.

  • PCI DSS Standards: We follow the Payment Card Industry Data Security Standards (PCI DSS) to maintain top-tier payment protection.

  • No sensitive payment details are kept on our systems.

To shield our buyers and stop fraudulent actions:

  • Every payment is screened for signs of fraud.

  • If the review doesn’t pass, we’ll cancel the order and return the payment.

External Payment Services
Payments on our site are securely managed by Shopify Payments and other reliable partners. These services align with worldwide security benchmarks. For more details, check their usage terms and privacy statements:

  • Shopify Payments Usage Terms

  • PayPal Usage Terms

Part 14 – Handling Issues or Complaints

The seller maintains a well-advertised process for addressing grievances and deals with them according to this established method.
Any issues regarding how the agreement was carried out must be reported to the seller with a thorough and precise explanation within a week of the buyer noticing the problem.
Grievances sent to the seller will receive a reply within 14 days of being received. If resolving the issue might take longer, the seller will send a confirmation of receipt within those 14 days, along with an estimate of when the buyer can expect a fuller answer.
If the matter can’t be settled peacefully, it becomes a disagreement subject to the conflict resolution process.
For any concerns, the buyer should reach out to the seller first before pursuing other steps.
Raising a grievance doesn’t pause the seller’s duties unless the seller explicitly indicates otherwise in writing.
If the seller finds the grievance valid, they’ll decide at their own judgment whether to swap out or fix the delivered items at no cost to the buyer.

Part 15 – Solving Disagreements

Agreements made between the seller and the buyer, as covered by these standard terms, fall solely under the authority of Swiss law, even if the buyer lives outside the Switzerland.

Part 16 – Extra Rules or Changes

Any extra or differing rules in these standard terms must not disadvantage the buyer and need to be documented in writing or in a format that allows the buyer to save them on a long-lasting storage device.

Part 17 – Refund and Return Policy
